AGREEMENT

1) illy sustainArt is an illycaffe spa project. Any reference made to illy sustainArt has to be considered as a reference to illycaffe' spa, Via Flavia 110, Trieste, Italy.

2) By submitting the present material the artist/curator and art critic grants the illy sustainArt Observatory the right to open a personal account with all related services, on behalf of the artist, curator, and art critic. All submitted information will be processed through an editorial process which complies with our editorial policy.

3) The illy sustainArt Observatory is responsible for the website's updates and maintenance. However, it may not be accountable for temporary nor permanent disconnection of the portal.

4) If, at any time, the user's personal account is used in an unlawful or illicit way (according to Italian law) by the user himself/herself or any other third party, the illy sustainArt Observatory will not be responsible under civil nor penal jurisdiction and it will reserve the right to stop the service immediately.

5) If, at any time, information submitted by artists curators and art critics is found to be untrue, the illy sustainArt Observatory reserves the right to close immediately, and with no further notice, the relevant personal account. This also applies if artists curators and/or art critics have been nominated for the offline version of the online exhibition. Their right to exhibit offline as part of any the illy sustainArt Observatory's activities will be revoked.

6) The artist, in accordance with the Italian law, can submit to the illy sustainArt Observatory works that contain personal data (including images depicted or not depicted) of a third party, only by previous consent of the third party. If the artist submit personal data to the illy sustainArt Observatory without previous documented consent of the third party, the personal data of the third party will not be published on the personal account nor elsewhere on the website and their personal profile will be cancelled. The artist can publish in his own personal account data of a third party only by previous consent of the third party itself. If the artist doesn't have the consent of the third party, the illy sustainArt Observatory will reserve the right to stop the service immediately and will not be responsible under civil nor penal jurisdiction.

PROMOTION

7) The artist/ curator and art critic grants the illy sustainArt Observatory the right to use submitted images and text for promotional use on the Internet, and any other promotional material. The material and images uploaded, will not be used for commercial purposes.

8) Registered users may close their personal account at any time, and they may do so by notifying their wish to the editorial team at the following address info@illysustainart.com. Material of unregistered users will not be used by the illy sustainArt Observatory for promotional purposes either through the Internet or any other form in future promotional activities.

COPYRIGHTS

9) The artist, curator, art critic ensures that copyright for all submitted material belongs to him/her, and if shared, will notify the editorial team and provide proof of approval of submission by whoever shares copyright. If this is not provided, content will not be published on the personal account nor elsewhere on the website. All artworks economic rights remain authors' copyrights. Artists declare and guarantees copyright's ownership of artworks that will be uploaded on the website. The artist therefore relieves illy sustainArt Observatory from any illicit use or violation of copyright of third parties.

10) Curators and art critics grant the illy sustainArt Observatory the right to freely use their selection criteria by which they create the online exhibition. They therefore grant the illy sustainArt Observatory unlimited right to publicise and divulgate through the website articles, introductions, reviews written by them and online exhibitions. Curators and art critics relieve illy sustainArt Observatory from any illicit use or violation of copyright of third parties.

11) The illy SustainArt Observatory is responsible for stating on users personal account and in any other section where users work will be published that ‘All artists/curators/art critics retain full copyright of individual works and written texts'. However, it will not be accountable for unlawful use of copyright made by third parties.

12) Curators and art/critic who register to the website and write reviews on one or more registered artists' work grant the specific artist the right to use the written review for bibliographical purposes, as long as the author is credited in all circumstances. Written reviews by registered curators may not be used by the artist in question for commercial purpose without author's authorisation. Reviews written by curators on specific artists will be published both on the author's personal account as well as on the artist's in question personal account.

13) Registered curators/art critics who will create online exhibitions ensure that exhibition concepts are original, have not been previously realised either on the Internet or in off-line edition elsewhere and that concept ideas do not belong to others.

DISCLAIMER

14) Opinions expressed through the illy sustainArt Observatory are those of the author/s and do not express illy sustainArt Observatory's point of view.

15) All registered users relieve illy sustainArt Observatory from any responsibility connected and or deriving from contents, from valuations and comments on the works reproduced and shared through the website.

GOVERNING LAW

16) This agreement shall be agreed upon by both parties and shall be governed upon and interpreted according to Italian Law.

17) All disputes arising out of or deriving from this Terms and Conditions in connection with the determination and assessment of incorrect practices by artists, curators and/or art critics registered to the website, will be resolved by an independent recognised art critic appointed as arbitrator upon agreement by both parties. The arbitration shall comply with law and equity.
