  1. Terms and Conditions
Our loyal customers, in order to guarantee that you continue to enjoy the same illy experience as always, we must inform that we will be passing a price increase. This has been a result of an increase in the cost of green coffee and of the materials necessary for the production of the machines, packaging and energy throughout our supply chain. We will be changing the prices of tinned coffee beans and ground coffee products, instant coffee and illy Cold Brew, starting on 1 February 2023, as well as the Y3.3 Iperespresso machine. As a B Corp, transparency throughout our supply chain is paramount and an increase allows us to remain committed to supporting our farmers and coffee partners, and ensuring we continue to pay above market rates to support our coffee growers and their communities.
TERMS AND CONDITIONS

Terms and Conditions in force from 12/04/2021

1.          Whereas

The following Terms and Conditions of sale regulate the supply of Illy products (both coffee machine both  food branded Mastrojanni, Domori, Agrimontana, Taittinger, Maritani e Dammann Freres) made via Website https://www.illy.com/en-gb (hereinafter “The Website”) or by calling the Customer care number 01604 821234 (hereinafter “The Customer Care”). These Terms and Conditions of sale are compliant with the applicable Consumer protection and e-commerce transactions laws.

The applicable General Terms and Conditions are those in force at the time of conclusion of the order confirmation according to the manners described under Article 4. By placing a purchase order, the Customer declares to be aware of and fully accept the conditions of sale. Their acceptance is a necessary condition for the conclusion of the contract.

These conditions do not apply to "machine subscriptions" and "coffee subscriptions", unless expressly mentioned.

The products can be purchased exclusively for domestic use and any form of sale to third parties is prohibited.

2.          Parties of the Agreement

The Parties of the Agreement are:

- illycaffè: illycaffè UK Limited, with registered office in Unit 7/8 Osyth Close, Brackmills Industrial Estate, Northampton, England, NN4 7DY, Tax Code and VAT number 325925492.

- Customer: the end user is either a natural person (as long as he or she is of legal age at the date of conclusion of the contract) or a legal person (e.g.: professionals, small companies). For large companies there are further forms of agreement.

3.          Products features and Price

The main features of the products can be found on the Website, on the related product section. Please consider that the images and colour of the products may not exactly match with the item delivered.

The products delivered to the Customer have a remaining shelf life of more than 4 months.

The products sold under the Program and, more generally, on the Website, are original products, with quality standards corresponding to those available on the market and distinguished by the trademarks owned by Illycaffè or licensed to it.

The products are sold at the price (VAT included) indicated on the Website at the time of the purchase.

Price does not include delivery costs, which will in any case be indicated separately in the final summary section before confirming the order, and in any case specified in the confirmation of receipt of the order sent by e-mail to the Customer.

4.          Conclusion of the contract

The Customer can proceed with the purchase in two alternative ways:

a) by telephone on 01604 821234 (Customer Care)

b) by internet via Website

Illycaffè has not authorized any other way to take out the purchase

4.1          Conclusion of the contract by Customer Care

The Customer can take out the subscription by telephone on 01604 821234, providing the operator with all the mandatory information to complete the purchase procedure.

4.2          Conclusion of the Contract via website

Registration is optional to purchase online.

If the Customer does not wish to register, he/she can still conclude a purchase by choosing the "checkout as a guest" mode: in this case only the data necessary for the delivery and possible invoicing of the order will be requested.

In case of registration, the Customer is required to maintain the confidentiality and security of his/her Credentials which shall remain under his/her responsibility. Any successful login using the Credentials of the Customer, regardless of whether it was executed by the effective owner or someone else, shall be deemed as a personal access by the Customer. illycaffè is not liable for any loss or damage in failure to comply with such contractual provisions.

The Customer undertakes to notify immediately illycaffè if he/she knows or has reason to believe that his/her Credentials have been stolen or misused, or in case of any other security issue.

Once the purchase order has been received, illycaffè will send a confirmation by e-mail. Such communication includes the summary of the undersigned terms and conditions and further details according to the applicable regulation relating to the rights of Consumers. The agreement is deemed accepted as soon as the Customer receives the confirmation from the illycaffè.

At the same time illycaffè will verify the availability of the ordered Product and, only after such verification, will communicate by e-mail its acceptance and start the procedures for the shipment of the product.

In case illycaffè is not able to fulfill an order received, it will promptly notify the Customer. In this case the order will be considered cancelled and no amount will be charged to the Customer.

Any right of the Customer to damages or compensation is excluded, as well as any contractual or non-contractual liability for direct or indirect damages to persons and/or things caused by the non-acceptance of an order.

5.          Sale conditions

The quantities of Products that can be ordered may be subject to minimum or maximum quantity limitations at illy's discretion, based on active promotions.

The promo codes proposed by illycaffè and its partners are valid only for the products and during the period indicated from time to time. Promo codes are non-refundable and are not cumulative. To take advantage of discounts and/or offers linked to promotional codes, you must enter the promotional code in the space provided when validating your order on the site or communicate it to the Customer Case staff. Subsequently, it will not be possible to modify the order to enter the discount code.

The language available to conclude the contract is English.

6.          Payment

illycaffè accepts payments only through the systems listed below:

a)       Credit card (American Express, Visa or Mastercard); through the payment platform of Deutsche Card Services (a Deutsche Bank group company) in cooperation with Computop Wirtschaftsinformatik GmbH. The total amount of an order will only be charged when the products are shipped. This information is not stored and/or archived by illycaffè. In no case can illycaffè therefore be held liable for any fraudulent or improper use of credit cards by third parties, whose details were communicated at the time of payment of the purchased products.

b)      PayPal: online payment system that allows any company or consumer who has an e-mail address to send and receive payments, subject to registration. Payment is made through the PayPal payment platform. 

 

7.          Delivery

The products are delivered by illycaffè only and exclusively in the United Kingdom territory.

illycaffè will ship the products ordered by the Customer, by courier, to the address indicated by the same at the time of purchase, approximately within 24 working hours of acceptance of the order. Delivery generally takes place within 4 working days. The times indicated for the receipt of the goods are indicative. illycaffè does not accept shipments to P.O. Boxes

Delivery charges are calculated on the basis of the rates indicated on the Site or communicated by Customer Service at the moment of the purchase.

 

8.          Check product

Any damage to the packaging and/or the product (visible without the need to open the package), or  mismatch in the number of packages must be immediately reported, giving specific indication of the delivery document. By signing the courier's document, the Customer certifies the external integrity of the product and the conformity of the delivery.

Any problems regarding the physical integrity, correspondence or completeness of the products received must be reported by sending an email to Customer Service at customerCareUK@illy.com or by calling the number 01604 821234.

Remedies and actions to be taken are described under clause no. 15.

9.          Billing

iIllycaffè will issue an invoice for each order placed by the Customer, whether private or professional and/or company, who has provided the necessary information (such as tax code and/or VAT number). For the issuance of the invoice illycaffè will use the information provided by the Customer at the time of registration or at the time of an order, providing for the possibility of indicating addresses other than those indicated for shipping. No variation of the data indicated in the invoice will be possible after the issue of the same.

10.          Withdrawal

The Customer may exercise, within 14 (fourteen) days from the date of delivery, the right to withdraw from the contract and obtain reimbursement of the amount already paid (including delivery costs), by sending the withdrawal form by registered letter with return receipt to the address: illycaffè UK Limited, with registered office in Unit 7/8 Osyth Close, Brackmills Industrial Estate, Northampton, England, NN4 7DY, or by calling Customer Service or, only if registered, by accessing the Site in the "my account" section.

Once the notice of withdrawal is received in the manner described above, the Customer Care team will contact the customer in order to agree on the method of return and to send the form to be filled in by the Customer. The Customer will then be contacted directly by the courier in order to agree on the date of taking charge of the return. The delivery of the goods to the courier must take place within 14 days from the date on which the withdrawal from the contract has been communicated.

The shipping costs for the delivery of the returned goods will be charged to the Customer, who will then be refunded in full by bank transfer.

It is essential that the products are returned intact; except for the handling necessary to verify the nature, characteristics and functioning of the product.

Once the integrity of the product has been ascertained, illycaffè will refund the Customer within 14 (fourteen) days following the return of the products. The Customer will be refunded the price paid for the product and shipping costs.

In case the value of the products has suffered a decrease caused by handling other than that necessary to establish the nature, characteristics and operation of the products, (for example: damaged products, not packaged regularly or completely, or in which certain parts are missing or have been damaged, such as components, elements, accessories, packaging materials, boxes, documentation and / or other objects), illycaffè will refund the Customer the amounts received after deducting the reduced value of the goods.

In the event that the Customer returns the products beyond the term of 14 days from the date on which he communicated the withdrawal from the contract or in the case of open and/or partially used products that do not lend themselves to being returned; the right of withdrawal does not apply and illycaffè will return the purchased goods to the Customer charging him the shipping costs.

With specific reference to food products the withdrawal right is not allowed.

11.          Remedies for defective products

If the product develops a fault according to article 10, the customer can choose between the following remedies:

-          Reject defected product (e.g.: products are of unsatisfactory quality, unfit for purpose or not as described): the customer shall communicate in writing by sending e-mail or calling Customer Service with his or her intention and illycaffè will provide a full refund. The customer can reject products within 30 days from the delivery date. After 30 days, the customer will not be legally entitled to a full refund if the product received develops a fault.

-          repair or replacement: illycaffè undertakes to repair or replace the product within a reasonable time through its Technical Assistance Centers.

Upon receipt of the report, illycaffè shall arrange for the collection of the defective product at its own care and expense. The products must be returned to illycaffè with all accessories and appliances included in the package, as well as packaged appropriately.

Within 6 months from the date products have been delivered, the customer has a final right to reject or a right to a reduction in price, after or instead of a repair or replacement, only where the products do not conform after repair or replacement, or illycaffè failed to repair or replace the product within a reasonable time and without significant inconvenience.

If the conformity defect becomes viewable within the first 6 (six) months after delivery of the product, it is presumed - subject to proof to the contrary - that it already existed at the time of delivery.

12.          Force Majeure

illycaffè cannot be held responsible if it is unable to process the order or is late in processing it due to force majeure (for example, but not limited to, production blocks imposed by legislative or administrative measures, epidemics, strikes, severe weather events, fires, floods), even if such events prevent or delay the activity of the courier in charge of delivering the ordered product.

13.          Law and jurisdiction

These Terms and Conditions of Sale are governed by the regulations of England and Wales and subject to the non-exclusive jurisdiction of the courts of England and Wales. 

14.          Final provisions

Please refer to the illy Lovers section for regulation governing points collection.
